- EU's TCMV removed the Tesla FSD vote from its October 6 meeting, scheduling only a 25-minute "continuation of discussions" on the Dutch Article 39 authorization request from 11:45 to 12:10, with no vote listed.
- The committee doesn't reconvene until December, making that the earliest an EU-wide Tesla FSD authorization can happen — overriding a September 1 Tesla Europe X post that pointed to October 6 and 70,000 customers across five countries.
- Sweden and France remain on opposite sides of the question: Sweden wants FSD rejected unless Tesla removes the above-speed-limit setting, while France has refused recognition outright over city speeding and driver attention; Nordic regulators also flagged icy-road risks.
- Only seven EU countries — Netherlands, Denmark, Belgium, Estonia, Lithuania, Slovenia, and Czechia — have recognized the Dutch approval, covering roughly 53 million people or about 12% of the EU population, far short of the 65% threshold required.
- Without winning over at least some of France, Germany, Italy, or Spain — which together hold about 58% of the EU population — the qualified majority needed under Article 39 is mathematically out of reach.

Why it matters: Tesla's path to EU-wide FSD authorization is now both procedurally blocked and numerically impossible before December: it needs a qualified majority representing 65% of EU population but currently has ~12% from seven recognizing countries, and the four big holdouts (France, Germany, Italy, Spain) control 58% of the population between them — meaning Tesla cannot pass even a perfect December vote without flipping at least one major market.
